NY Man Won't Be Tried for Under-Tipping

A man arrested in an upstate New York restaurant for not tipping enough is off the hook.

Local prosecutors say they won't charge Humberto Taveras for not leaving a big enough tip at Soprano's Italian and American Grill in Lake George, NY.

The 41-year-old Long Island man was arrested Labor Day weekend when the restaurant owner accused him of not leaving an 18-percent gratuity required for large parties.

Taveras says he wasn't aware of the policy and wouldn't have left that much money anyway because he wasn't happy with the service.

The Warren County district attorney's office says a restaurant patron can't be forced to leave a gratuity.

Prosecutors say establishments have to call it a service charge -- not a tip -- in order to make it a mandatory add-on charge.

Well, at least the prosecutor in Lake George, NY has got a clue, as does the DA in Warren County, NY. ;=3

I'm sitting here listening to Billy Joel, at the time, and the phone rings.

As you know I'm screening my phone calls, so the answering machine picks up and it starts its out going message:

"Lion's Den, head lion speaking. No, really this is Don Miller Junior. I can't come to the phone right now, but ... etc."

The message completes and I hear dead air. This happens occasionaly, but this time after 4 seconds a salesman starts speaking. You should've heard the uncertainty in his voice. ;=3

It was like he didn't know if this was a gag or what. ;=3

I started to laugh as it was funny to hear.

BTW, the (M-) in what I'm listening to is because the CMSL has P-RSL Budd RDC #M-409. ;=3
